China’s Supreme People’s Procuratorate has indicated that if a person administers “incapacitating drugs”—such as sleeping pills—for the purpose of sexual activity, and evidence exists to support this, the act should be prosecuted as rape rather than merely as a drug-related offense (which typically carries a sentence of three years or less). Rape is a serious crime punishable by a prison term of three years or more, up to and including the death penalty.
In one actual case, a man charged with repeatedly sexually assaulting women after using drugs to render them unconscious was sentenced to life imprisonment, requiring him to serve a minimum of 24 years before becoming eligible for parole.
