The Lamo Case and Loopholes in China’s Domestic Violence Law
China has previously witnessed shocking incidents of horrific violence committed by ex-spouses. In 2020, Lhamo, a Tibetan female blogger, was doused with gasoline and set ablaze by her ex-husband; she sustained burns over 90% of her body and died approximately two weeks later. Her attacker was convicted of murder and sentenced to death; the sentence was carried out in July 2022 in the Ngawa Tibetan and Qiang Autonomous Prefecture of Sichuan Province.
Systemic limitations in China’s approach to combating domestic violence have also been highlighted. Although China’s first Anti-Domestic Violence Law was enacted in 2015, its scope is considered limited; for instance, it excludes same-sex couples from protection and makes no mention of sexual violence. Studies indicate that approximately 24.7% of Chinese people experience domestic violence at some point in their lives, with some findings suggesting that partner violence occurs roughly twice as frequently in rural areas compared to urban centers. These facts reveal a reality where, despite legislative progress, the prevention of such abuse remains incomplete.
