Taiwanese ex-boyfriend picture leaked; up to 7 years in prison
In Taiwan, the Penal Code amendments that took effect on February 10, 2024 created a new chapter called “Obstructive Obscenity and Immoral Imaging,” making it punishable to take, copy, and spread sexual images and videos without the person’s consent. According to Article 319-3 of the Penal Code, those who reproduce, disseminate, or publicly display sexual images without permission are subject to a fixed-term prison term of up to five years and may also be fined. If the information is disseminated for commercial purposes, the punishment will be increased by one-half, reaching a maximum of seven years.
In fact, in the New Taipei District Court, a man who earned NT$8,600 by selling photos of his ex-girlfriend as sexual images without his consent was sentenced to five months in prison, and the proceeds of the crime were forfeited.
